The Special Education Program provides education services and related services to students with disabilities. Special education services are provided to all eligible district students as prescribed by the federal law titled the Individuals with Disabilities Education Act (IDEA). This law assures that students with disabilities receive a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE) as described in a written Individual Education Program (IEP) that is developed by the parents working with the educational team.

PROCEDURAL SAFEGUARDS


The Individual with Disabilities Education Act (IDEA), the Federal law concerning the education of students with disabilities, requires schools to provide parents of a child with a disability with a notice containing a full explanation of the procedural safeguards available under the IDEA and U.S. Department of Education regulations. A copy of this notice must be given to parents only one time a school year, except that a copy must be given to the parents:

  1. Upon initial referral or parent request for evaluation.
  2. Upon receipt of the first State special education complaint under 34 CFR 300.151 through 300.153 (OAR 581-015-2030) and upon receipt of the first due process hearing request under 300.507 (OAR 581-015-2345) in a school year.
  3. When a decision is made to take a disciplinary action against your child that constitutes a change of placement.
  4. Upon your request.

All of the rights in this document relate to Part B of the IDEA. Part B includes children from age three years (3) to twenty-one years (21). Oregon Department of Education also publishes notices of procedural safeguards for adult students ages eighteen years to twenty-one years (18 – 21) and for children ages birth – five years (1 day - 5) in Early Intervention/Early Childhood Special Education (EI/ECSE) programs.

This Notice of Procedural Safeguards also applies to parents whose children with disabilities attend any Oregon charter school. Under Oregon law, the district in which the charter school is located is responsible for special education.

NCLB (No child left behind)


Child Find is a continuous process of public awareness activities, screening and evaluation designed to locate, identify, and refer as early as possible all young children with disabilities and their families who are in need of Early Intervention Program (Part C) or Preschool Special Education (Part B/619) services of the Individuals with Disabilities Education Act (IDEA)

To receive Early Intervention Program or Special Education, children must meet eligibility guidelines according to IDEA. States have different eligibility guidelines for their Early Intervention Program and Special Education services. In addition to children with disabilities, some states have elected to provide early intervention services for infants and toddlers who are at risk of developmental delay and their families. For information on the definition of disability under IDEA and eligibility criteria for early intervention in your state, contact your state's Part C coordinator by visiting the ECTA Center State Part C Coordinators page.

IDEA requires all states to have a "comprehensive Child Find system" to assure that all children who are in need of early intervention or special education services are located, identified, and referred. The lead agency for Part C of IDEA Early Intervention Program and for Part B/619 (serving preschoolers with special educational needs) in each state is responsible for planning and implement a comprehensive child find system. In some states, the lead agency for the two programs is one and the same, while in others, different agencies oversee the two programs.
